TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRIVEN BY SAFETY, INC., ITS AFFILIATES, AGENTS, EMPLOYEES AND REPRESENTATIVES BE LIABLE UNDER ANY LEGAL THEORY, WHETHER BASED IN TORT, CONTRACT, WARRANTY, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, AND LOST EMPLOYMENT OPPORTUNITY, RESULTING FROM, ARISING OUT OF, OR RELATING TO THE USE OR INABILITY TO USE THIS DEVICE SHALL BE LITIGATED EXCLUSIVELY IN THE STATE OR SUPERIOR COURT OF FULTON COUNTY, GEORGIA AND GOVERNED BY THE LAW OF THE STATE OF GEORGIA.
